SMS Terms of Use

Ave Maria University Text Messaging Terms of Use. By opting in to or using a Text Message Service (as defined below) from Ave Maria University, you accept these terms.

This agreement is between you and Ave Maria University ("AMU," "we," "our," or "us"), 5236 Clancy Ave, Ave Maria, FL 34142.

Program Description

This program is one-to-one conversational SMS from university employees (including Mission Advancement Specialists) via Microsoft Teams, sent from the employee's assigned university phone number. Messages are for people who already have a relationship with the University (alumni, parents, donors, friends, and other constituents) and who have opted in.

This is not a marketing blast, bulk messaging program, automated alert service, or API-driven campaign. You may receive conversational replies and follow-up texts about your existing relationship with AMU, such as answering a question you asked or continuing a conversation you started with an employee.

Consent is optional. You are not required to opt in to SMS in order to donate or to remain a constituent of Ave Maria University.

Definitions

"Opting In," "Opt In," and "Opt-In" refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.

"Text Message Service" includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or successor protocols or technologies).

Consenting to Text Messaging

By consenting to receive text messages from us, you agree to these SMS Terms of Use, as well as our Terms & Conditions and Privacy Policy, incorporated here by reference.

You may opt in by any of the following methods:

  • Verbal consent, by phone or in person
  • Replying START to an employee's university number
  • Completing a web or paper form that includes an unchecked SMS checkbox

Opt-in is specific to SMS. It is not bundled with other services.

E-SIGN Disclosure

By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.

SMS Privacy

We respect your privacy. We only use information you provide through this service to transmit your mobile messages and respond to you. This includes sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages.

Mobile opt-in information will not be shared with third parties for marketing purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We reserve the right to disclose information as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect our rights or property. This SMS privacy section applies to your use of the Text Message Service and is not intended to modify our general Privacy Policy, which may govern the relationship between you and us in other contexts.

Costs of Text Messages

Msg & data rates may apply. Ave Maria University does not charge you for the texts you send or receive through this service. Your wireless carrier might. Depending on your plan, you may be charged by your carrier or other applicable provider.

Frequency of Text Messages

Msg frequency varies. This Text Message Service is for conversational, person-to-person communication between you and our employees. We may send you an initial message providing details about the service. After that, the number of text messages you receive depends on how you use the service and whether you take steps that generate more messages (such as sending a question or a HELP request).

Opting Out of Text Messages

If you no longer want to receive text messages, reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. After you opt out, you will receive a confirmation and no further messages from that employee number. Reply START to resume messages from that number.

As a person-to-person service, opt-out requests are specific to each conversation between you and one of our employees and their associated phone number.
